Terms and Conditions of Sale

These terms and conditions of sale apply to purchases of products at ECHTE.dk for delivery in Denmark, Sweden, Germany, Belgium, Austria and Poland.

Ordering and payment
You can shop on ECHTE.dk 24-7-365. However, we may occasionally close the online store for maintenance. You can only make purchases when the online store is open and accessible.

To shop at ECHTE.dk, you must be at least 18 years old and possess a valid payment card of a type that we accept. If you are not yet 18, you may purchase items with your guardian’s permission and/or if you are otherwise legally entitled to make purchases.

Select the items you wish to purchase. Save them in your shopping basket. You can edit the contents of the shopping basket until you finally place your order, so you can check the contents of your basket and prices under way.

Any additional charges, e.g. for delivery and card fees, will be added before you make your payment.

When you are ready to order, click ‘Payment’. Enter your name, address, email address, phone number and payment method. Select a delivery method.

You can edit the contents of your shopping basket until you confirm your purchase by clicking the ‘Go to payment’ button. At this point, your order is forwarded to ECHTE.dk and can no longer be changed.

You must enter a valid address for the delivery of the products. If the address you have entered cannot be verified, ECHTE.dk reserves the right to withhold delivery and cancel the order.

We accept payment with Anyday.
The amount will only be deducted from your card when the item is shipped.
When you choose to pay with Anyday, the first payment is deducted when the item is shipped. Then you will pay your monthly installments on the last weekday for three months onwards, beginning from next month.
No fees and interest will be charged for your purchase if you pay on time. If you return your purchase, the agreement with Anyday will terminate automatically.

Prices and delivery

Price per item, delivery costs and other costs stated on ECHTE.dk include VAT, other taxes and excise duties. ECHTE.dk is not liable for printing errors, price changes, delayed delivery and items that are out of stock. 

Currency
Prices vary depending on the country of delivery. If you wish to change your choice of country, please use the ‘Change currency’ function at the top of the page. Please note that changing country may influence price/currency and delivery costs. Your order can only be delivered to a country in which you have a registered address. 

Terms of delivery
Items ordered at ECHTE.dk can be delivered to an address in Denmark, Sweden, Germany, Belgium, Austria or Poland. Delivery times will depend on the country of delivery and the carrier used. 

We deliver to private addresses or parcel shop. You must sign for the items on receipt/collection. You or someone else at the delivery address must sign for receipt, with binding effect for you. Please note that you carry the risk for items purchased after delivery.

When you have received the parcel, you should check the items. If the parcel and/or its content is/are damaged, you must contact our Customer Services department or the carrier immediately. If you wish to complain about faults and defects, you must notify us. See ‘Claims - defective goods’ below.

Dispatch
You can track your parcel via track & trace from its dispatch until its delivery.

We deliver the parcel to the address you entered on the webshop. If you are not at home when the carrier arrives, you can collect your parcel at the Post Office (depends on your local service).

DKK 30 – 1-2 business days – Free shipping on orders over DKK 850

Sweden:
SEK 45 – 2-5 business days – Free shipping on orders over SEK 1.250

Germany:
€ 5 – 2-4 business days – Free shipping on orders over € 115

Belgium:
€ 5 –    2-5 business days – Free shipping on orders over € 115

Austria:
€ 5 – 2-4 business days – Free shipping on orders over € 115

Poland:
€ 5 – 4-6 business days – Free shipping on orders over € 115

Card purchases
At ECHTE.dk, you can pay using the following payment cards:
Visa, Visa Electron, Maestro and MasterCard.
ECHTE.dk charges no fees for payments made with the above cards.

We offer payment by invoice in cooperation with Viabill (Denmark only). If you place your order with Viabill, payment will be deducted from your bank account when you pay the invoice.

We offer payment by invoice in cooperation with Klarna (Sweden only). If you place your order with Klarna, payment will be deducted from your bank account when you pay the invoice.

The amount is withdrawn from your account when the items are dispatched from our warehouse. We never deduct a larger amount than that you approved when placing your order.

If you pay using a debit card, the amount is pre-authorised as soon as we register your order. When we dispatch the items from the warehouse, the pre-authorisation is cancelled and the amount deducted from your account. If, in the meantime, your order is cancelled, we will cancel the pre-authorisation. Precisely when the amount is available in your account depends on the card provider.


Secure shopping

It is safe to shop at ECHTE.dk. The data you provide when making a purchase on a card are SSL-encrypted to guarantee you a 100% secure purchase. No one at ECHTE or elsewhere can read the data.

Cancelling orders

ECHTE.dk retains the right to cancel an order if it is not possible to deliver the product ordered. If a situation of this type should arise, you will be notified and any payment or pre-authorisation made on a payment method will be refunded/cancelled.


Order confirmation 

When you have ordered an item, we send you an email to confirm that we have received your order. When the item is dispatched from our warehouse, you receive an order confirmation note. Please note that it is only once you receive the email confirming your order that both parties have entered a binding contract of sale. Finally, you receive an email notifying you of the parcel’s Track and Trace number so that you can track your parcel’s progress. Any product displayed on our website is not an offer, but rather an invitation to you to make an offer.

30-day right of cancellation
When you make a purchase at ECHTE.dk, you have a right to cancel your order within 30 days, during which time you can notify us that you wish to cancel your purchase and return the goods to us.

Your right to cancel applies from the day you receive the goods.

If the 30-day period expires on a Danish public holiday, a Saturday, Danish Constitution Day, Christmas Eve or New Year’s Eve, the deadline will be extended to the next working day. Once you have received the goods, they must be handled solely so that you can establish the type of goods, their condition and how they function.

In other words, if you wish to avail yourself of your right to cancel, the goods must be returned in the same condition as when you received them. To avail yourself of your right to cancel, you must clearly notify us within 14 days of receiving the goods that you intend to return them.

If you regret your purchase, you can use a return note. There is one enclosed in every parcel you receive from us.

If you use the return note, you do not otherwise need to notify us of your decision to cancel.

IMPORTANT

We expect you to dispatch the goods as soon as possible after notifying us that you wish to return them.
To avail yourself of your right to cancel, you must return the goods no later than 14 days from the day you notified us of this.

Free 30-day returns

ECHTE.dk offers free 30-day returns if you use the enclosed DAO or GLS return label.

If you would like to exchange your item for a different colour or size, please return the unwanted item and place a new order.

When you return goods, you should ensure that the goods are responsibly packed.

You are liable for the parcel and goods until we receive them.

Save the carrier’s receipt and Track & Trace number (if any).

The absence of the original packaging may devalue the product.

To ensure that you receive a full refund, we recommend that you return the goods in the original packaging and with all its labels.

If you regret your purchase, you must pay the cost of returning the goods.

If you return the goods using the enclosed DAO or GLS return label, return freight is, however, free of charge.

If you choose not to use the pre-paid return label (and therefore also to pay the full cost of sending the parcel), please send it to:

NB:
We do not accept delivery of parcels in person to the above address.
We do not accept parcels sent COD (Cash on Delivery) or on similar terms.
When returning goods, please enclose documentation for your purchase and the return note. 


You must enclose a copy of the order confirmation note or substantiate your purchase by other means, e.g. giving the order number.

To minimise the time taken to process returns, please fill out and enclose a return note. A return note is enclosed in the parcel when you receive your order.

Refunds
It usually takes 14 days to process the return.

When we have completed this process, we will issue a refund using the payment method used to pay for the order. This can take up to five working days.

We reserve the right to withhold the refund until we receive the goods.
The refund amount will be transferred to the same payment method as was used to pay for the order.
If, for example, you paid for your purchase with a card, the full or part of the purchase price will be refunded to the same card.

NB:
All or part of your refund is forfeited if the goods returned are devalued for any of the following reasons:
• you have actually used/worn the goods
• the goods were damaged while you were liable for them
• you have handled the goods other than is necessary to establish the type of goods and their function
• you have not observed restrictions associated with the right to cancel with regard to sealing, type of goods, etc.

Free returns – DAO or GLS

If you wish to return goods, please take the following steps:
Step 1:
Fill in the return note and pack the goods responsibly.
Cover or remove the original label and bar code.
Step 2:
Send the completed return note with the goods you wish to return.
Step 3:
Affix the enclosed return label to the outside of the parcel.
Step 4:
Send the parcel from either a DAO or a GLS parcel shop (depending on which of these you chose when you placed your order.)

Step 5:
When you have dispatched your return parcel, you can track it via the GLS website: gls-group.eu or via the DAO website: dao.as

NB:
You can track your parcel until it arrives at our warehouse.
If you do not use the enclosed pre-paid return label, you are liable for the goods until they arrive at our warehouse.
To ensure that the parcel is insured, don’t forget to ask for a receipt when you send it.
Returns are free of charge when you use our return label – from either DAO or GLS.
The return label enclosed in your parcel is for the carrier you chose to deliver your purchase.

Claims - defective goods
Your purchase is covered by the provisions of the Danish Sale of Goods Act, including those pertaining to defective goods.

This means that defective goods may be repaired or replaced, and/or you may receive a refund or a reduction in the price, depending on the specific case.

According to the law, you have a right to claim within 24 months of purchase.

Your claim must of course be justified and the defect must have been caused neither by incorrect use of the product, ordinary wear-and-tear nor other damaging behaviour.

You must contact us within a “reasonable period of time”.

You must lodge a complaint within a “reasonable period of time” of discovering the defect.

We recommend that you lodge your complaint as soon as possible and within two months of discovering the defect.
To make a claim, send us an email to customercare@echte.dk or call +45 35 30 10 91.

To help us to assess your claim, please ensure that:
1. You send us a brief description of the effect(s) of the damage or defect.
NB: Please contact our Customer Team Department as soon as you discover the defect.
2. To document the defect, please send 3-5 photos with the description.
The defect should be clearly seen in the photos.
You should also make sure that the photos show the entire product (front and back).
3. You send the photos and brief description to us by email to customercare@echte.dk
4. You notify us of the order number the goods were ordered under – or enclose a copy of the order confirmation note/receipt.
5. Once we have received your photos, we will process your claim as soon as possible.
If you need to return goods as part of a complaint, ECHTE.dk will send you a pre-paid return label, which must be used.
If you choose not to use the pre-paid return label (and therefore also to pay the full cost of sending the parcel), please send it to:

Discount codes (vouchers)


As part of marketing campaigns, we regularly offer discount codes. These are valid for limited periods only, and may be subject to specific conditions. The use of some codes may be limited to specific products or categories.

When you use a discount code, your purchase must be more than or equal to the stated minimum purchase sum. If your purchase is less than the minimum purchase sum, the difference will not be refunded. You must enter the discount code you wish to use during the purchase process, i.e. before you pay for the order. No discount code will be applied to your order after you have placed it. Only one discount code can be used per order.

Discount codes are not personal and may be used by the holder. Discount codes have no cash value and cannot be redeemed for cash, credit notes or similar.

In cases of fraud, swindle or suspicion of illegal activity of any kind in relation to the use of discount codes, we have a right to nullify the discount code, cancel the order on which the discount code was used, and permanently prohibit the purchaser from shopping on ECHTE.dk.
 

Personal data

When you shop on ECHTE.dk, you must at least provide your:

• Name
• Address
• Email address
• Phone/mobile number.

In accordance with the Article 10 of the Danish Bookkeeping Act, the above data are stored with information about the products you have purchased for a period of five years from the end of the accounting year the data relates to, after which time the data is erased.

The collection of personal customer data at ECHTE.dk takes place within the scope of existing legislation and the EU General Data Protection Regulation (GDPR).

ECHTE.dk collects users’ data from five sources:
•    From cookies when you visit our websites, e.g. IP address, country, pages displayed, categories displayed, brands displayed, interactions/clicks and searches.
•    From purchases, e.g. demographical data, email address, payment details, features, products, order total, discount level, brands and frequency. This includes the sending of transaction emails, e.g. order confirmation, dispatch confirmation and refund confirmation.
•    From user behaviour and engagement with communications sent (email, direct mail or phone), e.g. opening speed, click speed and time spent reading the emails, sender domain and type of email client.
•    From users who provide information about themselves (e.g. by adding information to their customer profile)
•    From credit rating information supplied by a third-party rating company.
 
The purposes of data collection are manifold: 
•    Obligations. To fulfil our obligations to you as a customer or user of our service –e.g. purchases, invoicing and customer services.
•    Customer Services. To be able to perform customer service via email, chat or phone. To respond to questions about current or previous orders, correct errors and guide the customer.
•    Marketing. To display inspiration, product deals/services and personalised recommendations via web, email, direct mail, phone and via third-party marketing activities.
•    Customer experience. To improve the customer experience in interactions with ECHTE, such as personalisation of your experience at ECHTE.dk, development of new features, services and products. This also includes managing, protecting, running and maintaining our websites, system administration and security, your consent to aggregated statistics on the use of the site and purchases and improving our understanding of our customers’ preferences.
•    Fraud and risk. To prevent fraud and perform risk assessments.
•    Legislation. To comply with relevant legislation.
 
Profiling

ECHTE creates individual customer profiles based on data collected about you across all data sources/categories, e.g. browsing behaviour along with your purchases and information you have provided (e.g. favourite brand and favourite products). We combine and analyse this data for the purposes of improving your experience at ECHTE.dk and customising personalised offers and services as well as defining the frequency of communication.

The messages you receive from us via email are customised for you in line with your data, browsing behaviour, buying behaviour and how much you engage with the communication we share with you via email.

Duration of data storage
We do not store your personal data for longer than is necessary for us to fulfil the purposes described above, or than we are legally obliged to. After this time, your personal data will be erased. Invoices are saved in accordance with the Danish Bookkeeping Act, and customer club data is saved for 36 months from the last point of activity. 

Updates to our personal data protection policy
It may be necessary for us to update our personal data protection policy. The latest version of the will always be available on our website. We will communicate important changes to the policy, e.g. changes to the purposes for which we use your personal data, who is responsible for them or your rights.

Browsing
When you visit ECHTE.dk, we collect data about visits to our website. We use the data to improve your user experience, evaluate your use of the individual elements at ECHTE.dk, and improve our marketing activities.

Browsing can trigger a service email
ECHTE collects data on your browsing behaviour (e.g. categories and products displayed) to be better able to communicate relevant products and deals to you. 

For example, we track when you add products to your shopping basket but choose not to complete the purchase. You may then receive a service email reminding you of the products you left in your shopping basket. If you do not wish to receive these emails, you must unsubscribe from our newsletters. Click the link at the bottom of each email. 

Analytical tools
We make use of various analytical tools, e.g. Google Analytics, which helps us to collect statistics on the use of ECHTE.dk, to give you a better experience.

We do not divulge or sell data to third parties, except in connection with restructuring, or full or partial sale of the business. Any data transfer made in a situation of this kind will comply with the relevant personal data legislation.

Newsletters
When you subscribe to our newsletter, you consent to receive ECHTE emails containing inspiration, exclusive offers and personal recommendations. These messages include content from ECHTE.dk and are sent via third-party software, which complies with GDPR data protection requirements. We use your purchases and browsing data to customise the offers we send to you. You can unsubscribe at any time.

The messages you receive from us via email are customised for you in line with your data, habits, browsing behaviour, buying behaviour and how much you engage with the communication we share with you via email.

To ensure that our email newsletters do not end up in your spam folder, we monitor whether the messages sent to individual recipients are successfully delivered. We use third-party software to follow up on these emails and analyse delivery frequency.

Cookies
When you use ECHTE.dk, you consent to our use of cookies. A cookie is a small text file saved in your browser that allows us e.g. to track your movements during your visit to ECHTE.dk and recognise your computer upon return visits. A cookie is not a computer program and does not contain any virus.

Breach of contract
If the customer fails to comply with contractual obligations in relation to these terms of sale and delivery, ECHTE.dk may block or limit the customer’s use of the ECHTE.dk website. If so, the customer will not be able to place orders.

The following are considered significant breach of contract
• The customer provides false information regarding their name, address, email address, phone number
• The customer harasses ECHTE.dk, our staff or other customers

ECHTE.dk reserves the right either to block or limit the customer’s future use of the ECHTE.dk website or to charge the customer for return delivery in cases where ECHTE.dk believes that the customer has misused his/her account or returned goods, or displayed buying behaviour or exploited free returns in a manner other than can reasonably be deemed normal and that imposes or threatens to impose on ECHTE.dk’s costs, risks or liability. In the event of an issue relating to suspension/limitation or a charge for return delivery, ECHTE.dk reserves the right, by dint of the above proviso, to implicate past incidents and specific circumstances in the current case. ECHTE.dk may elect to disregard past incidents and act at our own discretion.

Right to complain
If you wish to complain about your purchase, please contact customercare@echte.dk or call +45 35 30 10 92. If we fail to find a satisfactory solution, you can submit a complaint to the European Commission’s online complaints portal. When submitting a complaint, you must provide our email address, customercare@echte.dk. 



You can submit a complaint about goods purchased from us to the Danish Dispute Resolution Institute, Nævnenes Hus, Toldboden 2, 8800 Viborg, Denmark. You can submit a claim online through Klageportalen for Nævnenes Hus.

Law and jurisdiction
Purchases made at ECHTE.dk are subject to Danish law. Disputes shall to be settled at a Danish court of law.

Access to data and changing, updating or erasing data
As our customer, you have a right to access your data categories collected (Articles 15, 16 and 17) and a right to object to data registration in accordance with the relevant sections of the EU General Data Protection Regulation (GDPR). On receipt of a relevant request, we will update, change or erase any personal data we control, unless legally prevented from doing so.

We can reject requests that are repeated without good reason, that require a disproportionate technical intervention (e.g. the development of a new system or comprehensive changes to existing processes) or that affect other data subjects’ personal data.
